<p class="MsoNormal" style="text-indent:1.0cm"><span style="font-size: large;"><span lang="EN-US">1.&#160;</span><span lang="ZH-CN" style="font-family: SimSun;">越南《劳动法》规定，雇用</span><span lang="EN-US">&#160;10&#160;</span><span lang="ZH-CN" style="font-family: SimSun;">名劳动者的企业应当制定书面的劳动内规。</span></span><span lang="EN-US"><o:p></o:p></span></p>
<p class="MsoNormal" style="text-indent:1.0cm"><span style="font-size: large;"><span lang="EN-US">2.&#160;</span><span lang="ZH-CN" style="font-family: SimSun;">劳动内规不得违背《劳动法》和其他相关法律规定。劳动内规包括下列各主要内容：</span></span><span lang="EN-US"><o:p></o:p></span></p>
<p class="MsoNormal" style="text-indent:1.0cm"><span style="font-size: large;"><span lang="EN-US">(1)&#160;</span><span lang="ZH-CN" style="font-family: SimSun;">工作时间、休息时间；</span></span><span lang="EN-US"><o:p></o:p></span></p>
<p class="MsoNormal" style="text-indent:1.0cm"><span style="font-size: large;"><span lang="EN-US">(2)&#160;</span><span lang="ZH-CN" style="font-family: SimSun;">职场秩序；</span></span><span lang="EN-US"><o:p></o:p></span></p>
<p class="MsoNormal" style="text-indent:1.0cm"><span style="font-size: large;"><span lang="EN-US">(3)&#160;</span><span lang="ZH-CN" style="font-family: SimSun;">劳动安全、卫生；</span></span><span lang="EN-US"><o:p></o:p></span></p>
<p class="MsoNormal" style="text-indent:1.0cm"><span style="font-size: large;"><span lang="EN-US">(4)&#160;</span><span lang="ZH-CN" style="font-family: SimSun;">防范在职场的性骚扰；处理在职场性骚扰行为之程序、手续；</span></span><span lang="EN-US"><o:p></o:p></span></p>
<p class="MsoNormal" style="text-indent:1.0cm"><span style="font-size: large;"><span lang="EN-US">(5)&#160;</span><span lang="ZH-CN" style="font-family: SimSun;">保护企业的财产及经营秘密、科技秘密及智慧产权；</span></span><span lang="EN-US"><o:p></o:p></span></p>
<p class="MsoNormal" style="text-indent:1.0cm"><span style="font-size: large;"><span lang="EN-US">(6)&#160;</span><span lang="ZH-CN" style="font-family: SimSun;">获暂时调派劳动者从事劳动合同以外工作的场合；</span></span><span lang="EN-US"><o:p></o:p></span></p>
<p class="MsoNormal" style="text-indent:1.0cm"><span style="font-size: large;"><span lang="EN-US">(7)&#160;</span><span lang="ZH-CN" style="font-family: SimSun;">劳动者违反劳动纪律之行为，及纪律处分方式。</span></span><span lang="EN-US"><o:p></o:p></span></p>
<p class="MsoNormal" style="text-indent:1.0cm"><span style="font-size: large;"><span lang="EN-US">(8)&#160;</span><span lang="ZH-CN" style="font-family: SimSun;">物质责任；</span></span><span lang="EN-US"><o:p></o:p></span></p>

<p class="MsoNormal" style="text-indent:1.0cm"><span style="font-size: large;"><span lang="ZH-CN" style="font-family: SimSun;">越南政府颁布第</span><span lang="EN-US">145/2020/ND-CP</span><span lang="ZH-CN" style="font-family: SimSun;">号《关于</span><span lang="EN-US">&lt;</span><span lang="ZH-CN" style="font-family: SimSun;">劳动法</span><span lang="EN-US">&gt;</span><span lang="ZH-CN" style="font-family: SimSun;">实施细则的议定》第</span><span lang="EN-US">69</span><span lang="ZH-CN" style="font-family: SimSun;">条第</span><span lang="EN-US">1</span><span lang="ZH-CN" style="font-family: SimSun;">款规定：</span></span><span lang="EN-US"><o:p></o:p></span></p>
<p class="MsoNormal" style="text-indent:1.0cm"><span style="font-size: large;"><span lang="ZH-CN" style="font-family: SimSun;">企业必须制定劳动内规，雇用</span><span lang="EN-US">10</span><span lang="ZH-CN" style="font-family: SimSun;">名劳动者以上的，劳动内规必须以书面形式制定；雇用</span><span lang="EN-US">10</span><span lang="ZH-CN" style="font-family: SimSun;">名劳动者以下的，不强制要求颁布书面劳动内规，但必须在劳动合同中约定劳动纪律和违劳动者违规、违纪责任的内容。</span></span><span lang="EN-US"><o:p></o:p></span></p>
<p class="MsoNormal" style="text-indent:1.0cm"><span style="font-size: large;"><span lang="ZH-CN" style="font-family: SimSun;">企业没有书面劳动法规，企业与劳动者签订的劳动合同中也没有劳动纪律和劳动者违规、违纪责任内容的，企业就没有处罚劳动者的合法依据。因此，对劳动者的处罚，可能存在得不到法院的支持，被判决对劳动者承担不利法律后果的风险。</span></span><span lang="EN-US"><o:p></o:p></span></p>
<p class="MsoNormal" style="text-indent:1.0cm"><span style="font-size: large;"><span lang="ZH-CN" style="font-family: SimSun;">为规范劳动者管理，维护企业正常生产经营秩序、维护企业合法权益，企业有必要制定劳动内规；劳动者数量较少的企业，应当在与劳动者签订的劳动合同中明确劳动者违规处罚的内容。</span></span><span lang="EN-US"><o:p></o:p></span></p>
